What obligations does a Polish company posting employees to Germany have?

A Polish company posting employees to Germany must notify the German Customs Office (Zollamt), ensure the Mindestlohn rate, keep working time records, and settle with SokaBau in the case of the construction industry. In addition, each employee needs an A1 certificate confirming coverage by the Polish social insurance system. Depending on the type of activity, tax registration with the German Finanzamt and obtaining a Freistellungsbescheinigung may also be necessary .

How much is the Mindestlohn in Germany in 2026?

From January 1, 2026, the statutory minimum wage in Germany is 13.90 euros gross per hour, which at full time gives approximately 2418 euros gross per month. This rate applies to all employees performing work in Germany, regardless of citizenship and the employer's country of registration. In 2027, the Mindestlohn will increase to 14.60 euros per hour. It is worth remembering that in some industries, including construction, care, and cleaning, higher rates resulting from collective agreements apply.

What is A1 and does an employee posted to Germany need to have it?

A1 is a certificate issued by ZUS that confirms that a posted employee remains subject to the Polish social insurance system despite working in Germany. Without a valid A1, German authorities may consider the employee covered by the local system, which results in the obligation to pay German contributions. This document is mandatory for every posted employee from the first day of work in Germany, even if the posting lasts only a few days. During a Zollamt inspection, lack of A1 is treated as a serious violation.

When must a Polish company register with SokaBau?

All companies posting employees to work on German construction sites must register with the German holiday fund SokaBau (Urlaubs und Lohnausgleichskasse der Bauwirtschaft), regardless of the length of the posting and the size of the company. The registration obligation applies to both companies and sole proprietorships employing workers. After registration, the company submits monthly reports on employees and pays contributions to the holiday fund. What penalties apply for improper posting of employees to Germany?  

Violation of posting regulations, including failure to pay the Mindestlohn, lack of working time records, or failure to notify employees to the Zollamt, may result in a fine of up to 500,000 euros. In addition, the company may be entered in the Gewerbezentralregister, which in practice excludes it from German public procurement for several years. Zollamt and Finanzamt inspections are frequent, especially in the construction, transport, gastronomy, and care industries. Does a Polish company have to pay German income tax for posted employees?

It depends on the length of the posting and the place where the work is actually performed. Under the double taxation treaty, if the employee stays in Germany for less than 183 days in the tax year and the remuneration is paid by a Polish employer without a permanent establishment in Germany, income tax is paid in Poland. Exceeding 183 days or establishing a permanent establishment (Betriebsstätte) in Germany changes the situation and creates an obligation for German settlements. Each case should be verified individually, especially with long construction contracts.

What are the most common mistakes Polish companies make when posting employees to Germany?

The most common mistakes are failure to notify employees to the Zollamt before starting work, not keeping working time records compliant with German requirements, not paying the full Mindestlohn rate including allowances, and failing to register with SokaBau for construction works. Posting employees without a valid A1 or exceeding 24 months of posting without extending the certificate can be equally costly. Tax errors are a separate category: lack of Freistellungsbescheinigung resulting in automatic withholding of 15% Bauabzugsteuer, late VAT declarations, or failure to report a permanent establishment (Betriebsstätte) for long contracts.
