Who is entitled to Kindergeld in Germany?

Kindergeld is available to people legally working in Germany who pay tax and social security contributions in Germany. The benefit may be received by people employed directly by a German employer and - in certain cases - by people posted by a Polish employer.

Since 2024, important rules apply to the right to Kindergeld. People employed by a German employer may apply for family benefit without restrictions, regardless of the child's place of residence. Employees posted from Poland may apply for Kindergeld mainly when they are not entitled to family benefit in Poland or when it concerns adult children.

If one parent works in Germany and the other is not professionally active, it is possible to receive full Kindergeld and full 800 plus benefit in Poland. When both parents are professionally active, for example one works in Germany and the other in Poland, the so-called differential supplement is due. This means that the German family benefit is paid in an amount reduced by the value of the benefit received in Poland.

FAQ

How much is Kindergeld in 2026?

From 1 January 2026, Kindergeld is 259 euros per month for each child - regardless of birth order and the parent's income. The amount is identical for the first, second and every subsequent child.

Can a Pole working in Germany receive Kindergeld?

Yes. Kindergeld is available to anyone who legally works in Germany and pays contributions there - regardless of citizenship. The benefit may be received both by people employed directly by a German employer and, in certain cases, by employees posted by a Polish employer.

Can Kindergeld and 800 plus be received at the same time?

Yes, but it depends on the parents' employment situation. If the parent raising the child in Poland does not work, full Kindergeld (259 EUR) and full 800 plus are due. If both parents work - one in Germany, the other in Poland - only the differential supplement is due from Germany, meaning the difference between Kindergeld and the amount of 800 plus.

Until what age of the child is Kindergeld available?

As a rule, until the child turns 18. The benefit may be received longer - until age 25 - if the child continues school or studies. For a child registered as unemployed, the limit is 21 years. For a child with a disability certificate, Kindergeld is available without an age limit.

For how many months back can Kindergeld be received?

As standard, Familienkasse pays the benefit for a maximum of 6 months back, counting from the date of application. That is why it pays to submit the application as soon as possible - each month of delay is potentially 259 euros less. In certain situations, for example when an application was submitted in Poland or the office made an error, it may be possible to recover the benefit for a longer period.

How much does it cost to submit the application through your company?

The cost of handling a Kindergeld application is 1000 PLN, payable in advance. The fee is fixed - we do not charge commission on the benefit paid. The price includes completing documents, filling in forms, contact with Familienkasse and responding to the office's correspondence. In the event of a refusal decision, we file an appeal without additional fees.

What documents are needed for a Kindergeld application?

The basic set is: a copy of the child's birth certificate, an employer certificate from Germany on a Familienkasse form, a certificate of family composition from the municipal office, a document confirming the parent's employment situation in Poland and - if the child is an adult - a certificate from school or university. After contacting us, you will receive a personalised list of documents adapted to your situation.

Does my child have to live in Germany?

No. Kindergeld is also available when the child lives in Poland or another EU country. The condition is legal work by the parent in Germany and payment of contributions there. We handle only cases in which children live in Poland.

Can an employee posted from Poland receive Kindergeld?

Yes, but with restrictions. Posted employees may apply for Kindergeld mainly when they are not entitled to 800 plus in Poland - for example when the child has turned 18 and does not meet the conditions for the Polish benefit. If you are not sure whether your contract qualifies for the benefit, contact us - we will check your entitlement free of charge.

How long does it take to receive Kindergeld?

Familienkasse has a statutory 8 weeks to respond after a complete application is submitted. In practice, the procedure takes from 2 to 6 months - the office almost always asks for additional documents. The first payment covers overdue months from the date of application. We conduct correspondence with the office on your behalf throughout the procedure.

What happens if Familienkasse issues a refusal decision?

In the event of a refusal decision, we file an appeal and continue the case - without additional costs on your side. A Familienkasse decision is not final: the procedure includes three stages, and most cases can be effectively challenged if the documentation is correct.

Do I need to know German to apply for Kindergeld?

No. Familienkasse does not provide information in Polish, and all correspondence is conducted exclusively in German. We take over full contact with the office - we fill in documents, respond to letters and speak with Familienkasse on your behalf. You do not need to know a single word of German.
