Sokabau („Service und Vorsorge für die Bauwirtschaft“), as social funds for the construction industry, includes both the holiday equalisation fund and the supplementary pension fund. The purpose of Sokabau is to secure holiday pay for employees whom a Polish employer has posted to work in Germany.

It is worth emphasising that a Polish employer has not so much the right as the obligation to register with Sokabau every employee who will be posted by that employer to work on a German construction site. It will also be necessary to submit monthly reports for each of these employees.

Contributions paid to SOKA-BAU are calculated as a percentage of the gross salary of each posted employee. The employer pays the contribution in full on top of the employee's pay and may not deduct it from their wages. Companies based outside Germany that post workers there pay only the contribution to the ULAK holiday fund, whereas the contribution to the ZVK supplementary pension fund applies to German companies. The contribution rate depends on the region and the type of company, so the current rate should be checked with SOKA-BAU. Although at first glance the amount seems high, it is worth remembering that the vast majority of the funds paid returns to the company when the employee takes holiday - SOKA-BAU then reimburses the entire holiday pay.

Registration with SOKA-BAU is not a one-off formality - it is the beginning of regular reporting obligations. Every registered employer is obliged to submit monthly reports containing data on each posted employee: hours worked, gross salary amount and, where applicable, holiday days used. Reports must be sent to the Fund by the 15th day of the month following the settlement month. Failure to meet deadlines may result in SOKA-BAU estimating contributions based on its own calculations - usually higher than the actual amounts.

Failure to comply with the obligation to register with SOKA-BAU is not only an administrative matter - it can lead to serious financial consequences. German inspection authorities (Zollamt), during inspections on construction sites, verify whether foreign employees are properly registered. Finding irregularities may result in administrative penalties, and overdue contributions will be pursued retroactively with interest. In extreme cases, an undisclosed lack of registration may be classified as a breach of the regulations on posting employees (AEntG), which carries penalties of up to 500 000 EUR.

Technically speaking, a Polish company can register with SOKA-BAU independently and handle ongoing service itself. In practice, however, the language barrier, complicated forms in German and the risk of making mistakes in monthly reports mean that most entrepreneurs decide to use the support of a specialised office. Incorrectly completed forms or late reports can generate costs that are difficult to recover. Entrusting SOKA-BAU service to professionals is not only a saving of time - it is above all the certainty that all deadlines are met and contributions are calculated correctly.

Fenix-Tax will help your company both in starting and continuing cooperation with the German Fund:
When a given employee takes holiday, Sokabau will reimburse the company for the contributions it has paid for that employee. If, however, the holiday is not used, the employee will be entitled to payment of holiday compensation.
