Entry on the HFU list (Haftungsfreies Unternehmen) allows construction companies in Austria to avoid joint liability for subcontractors social security contributions under § 67b ASVG. A company on the HFU-Gesamtliste is exempt from the 25% deduction on payments from the contractor (20% social security contributions + 5% tax advance). In the construction industry, HFU listing is often a condition for cooperation with a general contractor, and lack of it may mean that part of the payment is deducted from every invoice.

The HFU list is a public register of construction companies that meet the conditions for exemption from the client's joint liability for the subcontractor's contribution arrears. If a company is not on the list, the contracting party is obliged to withhold 25% of the remuneration.
In practice, this means that:
- the contracting party may pay 100% of the remuneration without deductions only to a company on the list
- the listing increases the company's credibility in the subcontracting chain
- the absence of a listing may make it harder to sign a contract in Austria
For Polish construction companies operating in Austria, the HFU listing is one of the key formal elements when carrying out contracts.

To be added to the HFU list, a company must meet specific statutory requirements.
The most important conditions include:
- provision of construction services within the meaning of § 19 Abs. 1a UStG for at least 3 years
- no significant arrears in social contributions in the period up to 2 months back
- correct registration of employees in the insurance system (ASVG)
- complete contribution-base declarations
In the case of sole proprietorships without employees, insurance under the GSVG system is required, as well as the absence of arrears exceeding the permitted limits.
Before submitting the application, FENIX TAX verifies that the conditions are met in order to minimise the risk of rejection.

The procedure includes preparing the application (Erstantrag or an application for re-listing), gathering the required company data and attaching documents confirming the provision of construction activity for at least 3 years.
The documentation includes, among others:
- the company's registration data consistent with the Firmenbuch entry
- contribution account numbers and insurance data
- confirmations of VAT settlements for recent years
- consent to publish the data in the register
A decision on the listing is issued within up to 8 weeks of submitting a complete application.

For Polish companies providing construction services in Austria, being on the HFU list is particularly important when working in a subcontracting model. General contractors often require proof of listing before work begins.
In many cases, the absence of a listing results in:
- withholding of 25% of the value of each invoice
- delays in payments
- additional verifications by the contracting party
Therefore, the HFU listing is an element that safeguards the financial liquidity of a company carrying out contracts in Austria.

Being on the HFU list eliminates the withholding of 25% of the value of each invoice - consisting of 20% security for social contributions and 5% tax prepayment - which the contracting party is entitled to retain from a company not on the list. For Polish construction companies carrying out contracts in Austria, this means full payment of remuneration without delays resulting from the security procedure.
The listing also acts as a signal of credibility in the subcontracting chain. General contractors treat presence on the HFU-Gesamtliste as confirmation of the company's contribution reliability, which in practice translates into easier signing of contracts and the absence of additional verifications before each payment.

The listing is not a one-off formality - the company must maintain ongoing punctuality in paying contributions. Arrears or a sharp increase in employment (by at least 200%) may result in removal from the list, which immediately restores the 25% withholding obligation on the contracting party's side.
Obtaining the listing requires documenting at least 3 years of providing construction services in Austria, confirmed by VAT returns. For companies just entering the Austrian market or operating for less than 3 years, the listing is formally unavailable until the seniority condition is met. In addition, the application must be submitted in person or through an authorised representative directly at the DLZ-AGH centre, and the waiting time for a decision is up to 8 weeks - which, for an urgent contract, may be a significant time constraint.

Handling the application for listing on the HFU list includes:
- analysis of the company's status and fulfilment of the statutory conditions
- verification of contribution arrears
- preparation of the complete application
- indication of the required attachments
- conducting correspondence during the proceedings
- support in the event of a request to supplement documents
As a result, the entrepreneur reduces the risk of formal errors and shortens the time needed to obtain a decision.
